Washington Post editor stuns with surprising take on Trump ballot case

In a recent column, Ruth Marcus, associate editor at The Washington Post, argued that the U.S. Supreme Court should intervene and overturn the Colorado Supreme Court’s decision barring former President Trump from the state’s presidential primary ballot this year. Marcus expressed concern over the application of Section 3 of the 14th Amendment in this case, asserting that it should not impede voters’ choices in the upcoming election.

In her piece, Marcus urged the Supreme Court to take up the case, acknowledging the potential perception of partisanship given the conservative majority. She stated, “A decision that allows Trump to remain a candidate despite his role in the Jan. 6, 2021, insurrection — the most likely result, in my view — will be derided as the work of ‘partisan hacks.’” Despite potential skepticism, Marcus emphasized that Section 3 of the 14th Amendment should not be misused to prevent Americans from voting for their preferred candidate.

While Marcus acknowledged the conservative majority’s record, she advocated for the best outcome to be a unanimous Supreme Court decision, preferably 8-0 with Justice Clarence Thomas recusing himself, allowing Trump to run. Marcus cited dissenting Justice Carlos Samour Jr.’s concerns about potential chaos resulting from state-by-state adjudication of Section 3 disqualification cases.

Highlighting Justice Samour’s opinion, Marcus underscored the potential for chaos and the enlargement of state power, which she deemed contrary to the framers’ intent. She concluded by stressing the need for the Supreme Court to step in, emphasizing that there is no scenario in which the justices would empower states to remove Trump from their ballots.

Marcus also emphasized the importance of the Supreme Court presenting a united front in its decision, comparing it to the unanimous court of Brown v. Board of Education rather than a divided, party-line body like Bush v. Gore.

  4. The 14th Amendment was written in response to the Civil War, when people had fought against the Union were running for office in order to stop the Reconstruction efforts.
    BTW – all of you leftwad fascists keep yapping about Jan 6th and calling it an “insurrection”
