<p>In a new ruling, the Supreme Court sided with Virginia against a mandate from the Biden-Harris administration, which sought to prevent the state from purging non-citizens from its voter rolls before the upcoming presidential election. The Court’s decision, a 6-3 order, permits Virginia to enforce its state law to remove non-citizens from its voting lists, pushing back against a lower court&#8217;s ruling that supported the administration&#8217;s directive.</p>



<p>The dispute originated after Attorney General Merrick Garland and the Department of Justice (DOJ) argued that Virginia’s actions violated the National Voter Registration Act, which prohibits states from updating their voter rolls within 90 days of an election. A federal judge in the Eastern District of Virginia had previously ruled that Virginia must cease its voter roll updates and inform those non-citizens that they are eligible to vote. Virginia’s governor, Glenn Youngkin, subsequently appealed the decision to the Supreme Court, resulting in a stay on the lower court&#8217;s order.</p>



<p>The Supreme Court’s order reads, “The application for stay presented to The Chief Justice and by him referred to the Court is granted&#8230; pending the disposition of the appeal in the United States Court of Appeals for the Fourth Circuit and disposition of a petition for writ of certiorari, if such writ is timely sought.” This ruling allows Virginia to continue its voter roll maintenance practices under its state law, which has been in effect since 2006.</p>



<p>Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented, advocating for the Biden-Harris administration’s position to allow the DOJ’s instructions for voter list maintenance to stand. They argued that Virginia’s actions within 90 days of an election could interfere with federal election law.</p>



<p>This issue has sparked intense debate over voter list maintenance, as Virginia officials assert that the state’s existing procedures are lawful. Virginia’s law mandates that any individual flagged as a non-citizen is notified three times, giving them the opportunity to either confirm or correct their citizenship status. Governor Youngkin criticized the DOJ’s stance, stating, &#8220;Let’s be clear about what just happened: only eleven days before a Presidential election, a federal judge ordered Virginia to reinstate over 1,500 individuals–who self-identified themselves as noncitizens–back onto the voter rolls.&#8221;</p>

<p>Virginia’s approach includes daily voter roll updates, removing individuals flagged as ineligible while adding new eligible voters. The DOJ, however, challenged these updates as a “systematic voter removal program” deemed too close to the election to be compliant with federal law.</p>



<p>Virginia’s DMV also plays a role in this process, registering voters when issuing driver’s licenses and flagging individuals who identify as non-citizens. The DMV then notifies election officials to ensure only eligible citizens remain on the voting list.</p>



<p>With the Supreme Court’s decision, Virginia can now continue its voter roll updates, including removing non-citizens who may seek to vote in the upcoming election, as the case moves forward in the Fourth Circuit Court of Appeals.</p>

<p>A recent survey has brought to light a concerning revelation – 1 in 5 voters who utilized mail-in ballots during the 2020 presidential election openly admitted to engaging in some form of voter fraud, according to the <a href="https://web.archive.org/web/20231215171822/https://www.washingtontimes.com/news/2023/dec/15/more-than-20-of-voters-who-used-mail-in-ballots-in/"><em>Washington Times</em></a>. In a historic election where nearly 43% of voters opted for mail-in ballots, the highest percentage in U.S. history, a staggering 21% confessed to filling out a ballot, either partially or entirely, on behalf of a friend or family member – a clear violation of legal norms across all states.</p>



<p>The survey, conducted by the conservative Heartland Institute in collaboration with Rasmussen Reports, further disclosed that 17% of mail-in voters confessed to casting their votes in a state where they were no longer permanent residents. An additional 17% admitted to signing a ballot or ballot envelope on behalf of someone else, actions that constitute fraud and, if exposed, could lead to the invalidation of the ballots.</p>

<p>Justin Haskins, the director of the Socialism Research Center at the Heartland Institute, emphasized the significance of the survey results, stating, &#8220;The results of this survey are nothing short of stunning. For the past three years, Americans have repeatedly been told that the 2020 election was the most secure in history. But if this poll’s findings are reflective of reality, the exact opposite is true.&#8221; Haskins underscored that the conclusions were drawn directly from the voters&#8217; own responses, dispelling any notions of conspiracy theories.</p>



<p>The findings have provided ammunition to critics of widespread mail-in voting, who argue that it creates a ripe environment for election fraud. Hans von Spakovsky, a senior legal fellow at the Heritage Foundation, labeled mail-in ballots as the &#8220;most insecure way of voting,&#8221; pointing out the lack of supervision from election officials and poll watchers, leaving room for coercion or undue pressure.</p>



<p>The survey also brought attention to the partisan nature of the debate surrounding mail-in voting, with Republicans expressing concerns about election security while Democrats champion it as an expansion of voting access. In the 2020 election, 58% of Joe Biden&#8217;s supporters claimed to have used mail-in ballots, compared to 32% of President Trump&#8217;s voters, according to Pew Research Center.</p>



<p>As the debate over mail-in voting continues, Michael Toner, former Chairman of the Federal Election Commission, predicts a shift in strategy for Republicans, anticipating increased efforts to encourage supporters to vote early. While concerns about the security of mail-in ballots persist, Toner acknowledges that once voters are provided with additional options, rolling back those avenues becomes practically impossible.</p>



<p>James Taylor, president of the Heartland Institute, stressed the need for forward-looking fixes to election rules and procedures, emphasizing the importance of a transparent and tamper-resistant election system, regardless of one&#8217;s stance on the 2020 election outcome.</p>

<p>According to a new report from Breitbart, California&#8217;s Riverside County announced Monday it had sent our 5,000 duplicate absentee ballots to residents in error. The county claimed none of them would count if voters attempted to vote twice. </p>



<p>Riverside County Registrar of Voters Rebecca Spencer claimed in a statement, &#8220;It is important to note that none of the duplicate ballots will result in a voter being able to cast more than one ballot,” adding, “I take election integrity seriously and apologize for the inconvenience.”</p>



<p>The county&#8217;s press release noted, &#8220;Each vote-by-mail envelope has a bar code. When the bar code is scanned as accepted at the Registrar of Voters office it automatically locks the voter’s record so that the voter can only vote once. If a voter who received two ballots returned both ballots, only one ballot would count. The first ballot received would be processed and the second ballot would be automatically voided.&#8221;</p>



<p>Breitbart <a href="https://www.breitbart.com/politics/2022/10/19/californias-riverside-county-mails-5000-duplicate-ballots-registrar-promises-wont-count/">adds</a>:</p>



<p><em>The county said voters who received a second ballot should destroy it, and submit only one ballot before Election Day, November 8.</em></p>



<p>Prior to 2,000, voters in California who wished to vote by mail would have to request to do so. During the pandemic, the state began sending vote-by-mail ballots automatically to all voters on the rolls. As a result, some people reported receiving ballots for people who no longer lived at the address recorded on the rolls, or for people who had already died.</p>



<p>Voters are required to sign their ballot envelopes when voting by mail; signatures are compared to those on the voter rolls, but “[e]xact matches are not required” by <a href="https://www.sos.ca.gov/administration/regulations/current-regulations/elections/signature-verification-ballot-processing-and-ballot-counting-emergency-regulations" target="_blank" rel="noreferrer noopener">law</a>.</p>



<p>The county added in its <a href="https://rivco.org/news/duplicate-ballots-sent-out-some-riverside-county-voters">press release</a>, &#8220;The computer system error is resolved and procedures have been put in place to prevent the error in the future.. Voters with questions or concerns regarding their ballot are asked to call the Riverside County Registrar of Voters at (951) 486-7200.&#8221;</p>

<p>A federal judge has upheld multiple parts of a Georgia voter integrity law that was challenged by left-wing activists.</p>



<p>According to <em><a href="https://conservativebrief.com/ga-law-65928/">Conservative Brief</a></em>:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>Judge J.P. Boulee of the United States District Court for the Northern District of Georgia upheld the parts of Georgia’s Election Integrity Law challenged by an organization that sends prospective voters prefilled absentee ballot applications.</p><p>VoteAmerica <a href="https://nypost.com/2022/08/19/georgia-ban-on-giving-out-food-water-in-election-line-upheld-by-judge/" target="_blank" rel="noreferrer noopener">sued </a>Georgia Secretary of State Brad Raffensperger to strike down portions of the bill that added requirements for organizations or individuals that mail prefilled absentee ballot applications to potential voters.</p><p>The bill, Georgia SB 202, was signed into law in May 2021 by Republican Gov. Brian Kemp. It includes three provisions that apply additional restrictions to such ballot applications.</p><p>Under the law, third-party organizations are prohibited from sending absentee ballot applications prefilled with the prospective voter’s required information. They are also prohibited from sending applications to prospective voters who have already requested an absentee ballot.</p></blockquote>



<p>The court wrote that absentee ballot applications must read, “This is NOT an official government publication and was NOT provided to you by any governmental entity and this is NOT a ballot. It is being distributed by [insert name and address of person, organization, or other entity distributing such document or material].”</p>



<p>The court wrote, “Further, this Court finds that combining speech (in the cover information) with the conduct of sending an application form, as Plaintiffs do here, is not sufficient to transform the act of sending the application forms into protected speech,” adding, “Plaintiffs’ pro-absentee voting message is not necessarily intrinsic to the act of sending prospective voters an application form.”</p>
