The trial of 45th President Donald Trump concerning allegations related to classified documents has been postponed indefinitely. On Tuesday, U.S. District Judge Aileen M. Cannon, a Trump appointee, decided that setting a trial date at this stage would be “imprudent” given the number of unresolved pre-trial motions. Cannon highlighted the importance of addressing these motions in her ruling. Special Counsel Jack Smith had already filed a superseding indictment on July 27, 2023, implicating Carlos De Oliveira, a maintenance worker at Trump’s Mar-a-Lago estate, after initially securing a 37-count indictment against Trump and his aide Walter Nauta in June.
In her order, Cannon explained, “Finalization of a trial date at this juncture—before resolution of the myriad and interconnected pre-trial and CIPA issues remaining and forthcoming—would be imprudent and inconsistent with the Court’s duty to fully and fairly consider the various pending pre-trial motions before the Court, critical CIPA issues, and additional pretrial and trial preparations necessary to present this case to a jury.” She subsequently canceled the trial’s scheduled date of May 20, 2024, intending to reschedule it later after addressing the outstanding pre-trial matters.
Smith acknowledged in a Friday filing that federal investigators hadn’t properly managed evidence following the August 8, 2022, search of Mar-a-Lago. “There are some boxes where the order of items within that box is not the same as in the associated scans,” Smith admitted. “There are several possible explanations, including the above-described instances in which the boxes were accessed, as well as the size and shape of certain items in the boxes possibly leading to movement of items.”
In this filing, Smith also admitted that prior statements to Judge Cannon were “inconsistent” with previous arguments.
Trump’s legal team filed a motion Tuesday to address the reported violations, expressing doubts about the investigators’ reliability. “It never occurred to us, until last Friday, that the prosecution team could not be trusted to perform the basic task of maintaining the integrity of such evidence despite the expansive resources at their disposal,” Trump’s attorneys wrote.
These reported irregularities “implicate, for example, President Trump’s motion to suppress evidence seized from Mar-a-Lago and the motion to dismiss based on prosecutorial misconduct,” the defense argued. They plan to request further disclosures and file additional motions if necessary, possibly seeking sanctions or even the dismissal of charges if the prosecution fails to show how it properly handled evidence.
There are many issues with this case. Why did the Biden organization work with the DOJ to push this case? Why did they with hold news of Biden’s secret documents until after the Mralogo raid? Why did the DOJ stop the files folks from contacting Trump in the beginning. BLUF, every president could be charged with what Trump was charged with but they were not. Biden actually had no right to have classified files as a senator nor a VP but he did. At least a president has special privileges. People, the Biden administration is corrupt and needs to be punished or it will be the end of our REPUBLIC. WE THE PEOPLE not we the government.
